{"id":1977,"date":"2024-06-28T18:06:02","date_gmt":"2024-06-28T16:06:02","guid":{"rendered":"https:\/\/advokatskakancelarijajecmenica.com\/?p=1977"},"modified":"2024-06-28T18:07:56","modified_gmt":"2024-06-28T16:07:56","slug":"employment-of-foreigners-in-serbia","status":"publish","type":"post","link":"https:\/\/advokatskakancelarijajecmenica.com\/en\/employment-of-foreigners-in-serbia\/","title":{"rendered":"EMPLOYMENT OF FOREIGNERS IN SERBIA-LAWYER"},"content":{"rendered":"<p class=\"p1\"><em><span style=\"font-size: 18px; color: #ff0000;\">The latest changes to the Law on the Employment of Foreigners made it possible to build a new legislative framework that is determined by flexibility, economy and expediency.<\/span><\/em><\/p>\n<p class=\"p1\"><span style=\"font-size: 17px; color: #000000;\"><span class=\"s1\">The basic principle for employment of foreigners is still the requirement to have a visa for a long stay based on employment, approval for <strong>temporary residence<\/strong> or <a href=\"https:\/\/advokatskakancelarijajecmenica.com\/en\/acquiring-serbian-citizenship-by-descent-lawyer\/\"><strong><em><span style=\"color: #008000;\">permanent residence<\/span> <\/em><\/strong><\/a>and <strong>unique permits<\/strong>.<\/span> Given that the unique permit institute incorporates both the <strong>right to stay and the right to work<\/strong>, the employment or self-employment of foreigners is carried out by obtaining an unique permit. We elaborated on this in more detail in one of our previous articles.<\/span><\/p>\n<p class=\"p3\"><span style=\"font-size: 19px;\"><strong><span style=\"color: #ff0000;\">EMPLOYMENT OF FOREIGNERS IN SERBIA WITHOUT UNIQUE PERMIT<\/span><\/strong><\/span><\/p>\n<p class=\"p1\"><span style=\"font-size: 17px; color: #000000;\">One of the significant novelties is the possibility for <strong>certain categories<\/strong> of foreigners to work in the Republic of Serbia without obtaining an unique permit. It is about the fact that the legislator recognized that there are categories of foreigners who should <strong>be made accessible<\/strong> to the labor market in the form of complete <strong>liberalization of their employment<\/strong>, respecting their specific ties with the Republic of Serbia, i.e. with its citizens.<\/span><\/p>\n<p class=\"p1\"><span style=\"font-size: 17px; color: #000000;\"><span class=\"s1\">Namely, the right to work in the Republic of Serbia, without an unique permit, is exercised by a foreigner who has been granted <a href=\"https:\/\/advokatskakancelarijajecmenica.com\/en\/residence-permit-in-serbia-on-the-basis-of-family-reunification-lawyer\/\"><em><strong><span style=\"color: #008000;\">temporary residence<\/span><\/strong><\/em><\/a> on the basis of:<\/span> 1) <strong>family reunification<\/strong> with a member of the immediate family of a citizen of Serbia, i.e. a foreigner who has been granted permanent residence; 2) <strong>ownership of real estate;<\/strong> 3) humanitarian residence; 4) <strong>studies<\/strong>; 5) scientific research work; 6) the status of presumed victim of human trafficking and victim of human trafficking; 7) <strong>independent residence<\/strong>; 8) performing the duties of an accredited foreign journalist; 9) volunteering; 10) religious service, etc.<\/span><\/p>\n<p class=\"p3\"><span style=\"font-size: 17px; color: #000000;\">These novelties represent a significant step forward in the direction of <strong>increasing the availability of the labor market<\/strong> for foreigners, thus making it easier for domestic employers to hire foreign nationals without going through standard procedures.<span class=\"s3\"> Previously, foreigners, family members of Serbian citizens, i.e. foreigners permanently residing in Serbia, had to attach a personal work permit in order to be able to work.<\/span><\/span><\/p>\n<p class=\"p1\"><strong><span style=\"font-size: 19px; color: #ff0000;\">THE ROLE OF THE NATIONAL EMPLOYMENT SERVICE<\/span><\/strong><\/p>\n<p class=\"p3\"><span style=\"font-size: 17px; color: #000000;\">The National Employment Service has <strong>retained its important role<\/strong> in the employment procedures for foreigners, with its actions limited to shorter deadlines than before.<span class=\"s3\"> Namely, the National Employment Service <strong>assesses the fulfillment of the requirements for<\/strong>:<\/span><\/span><\/p>\n<ol class=\"ol1\">\n<li class=\"li5\"><span class=\"s4\" style=\"font-size: 17px; color: #000000;\"><strong>employment<\/strong>;<\/span><\/li>\n<li class=\"li5\"><span class=\"s4\" style=\"font-size: 17px; color: #000000;\"><a href=\"https:\/\/advokatskakancelarijajecmenica.com\/en\/work-permit-for-special-cases-of-employment-of-foreigners-lawyer-belgrade\/\"><em><strong><span style=\"color: #008000;\">special cases of employment<\/span><\/strong><\/em><\/a>, namely:<\/span><\/li>\n<\/ol>\n<ul class=\"ul1\">\n<li class=\"li5\"><span class=\"s4\" style=\"font-size: 17px; color: #000000;\">for referred persons,<\/span><\/li>\n<li class=\"li5\"><span class=\"s4\" style=\"font-size: 17px; color: #000000;\">for movement within the company,<\/span><\/li>\n<li class=\"li5\"><span class=\"s4\" style=\"font-size: 17px; color: #000000;\">for an independent professional<\/span><\/li>\n<li class=\"li5\"><span class=\"s4\" style=\"font-size: 17px; color: #000000;\">for training and improvement<\/span><\/li>\n<\/ul>\n<p class=\"p1\"><span style=\"font-size: 17px; color: #000000;\">3)<span class=\"Apple-converted-space\">\u00a0 <\/span><strong>self-employment<\/strong><\/span><\/p>\n<p class=\"p1\"><span style=\"font-size: 17px; color: #000000;\">4)<span class=\"Apple-converted-space\">\u00a0 <\/span><strong>a visa for a longer stay based on employment<\/strong><\/span><\/p>\n<p class=\"p1\"><span style=\"font-size: 17px; color: #000000;\">The assessment for employment is carried out by <strong>assessing the fulfillment of the conditions<\/strong>, namely:<\/span><\/p>\n<ol class=\"ol1\">\n<li class=\"li5\"><span class=\"s4\" style=\"font-size: 17px; color: #000000;\">that the employer <strong>did not fire employees<\/strong> due to technological, economic or organizational changes in the workplace for which a unique permit is requested within <strong>90 days before submitting the request<\/strong> for a unique permit<\/span><\/li>\n<li class=\"li5\"><span class=\"s4\" style=\"font-size: 17px; color: #000000;\">that the employer <strong>initiated the implementation of the labor market test<\/strong><\/span><\/li>\n<li class=\"li5\"><span class=\"s4\" style=\"font-size: 17px; color: #000000;\">the existence of an <strong>employment contract<\/strong> or other contract by which rights based on employment are exercised<\/span><\/li>\n<\/ol>\n<p class=\"p1\"><span style=\"font-size: 17px; color: #000000;\"><span class=\"s1\">The <strong>request for conducting the labor market<\/strong> test is an integral part of the request for issuing an unique permit and is submitted <strong>by the employer electronically<\/strong> on the single portal.<\/span> The National Employment Service conducts a labor market test by determining whether there are persons on the record <strong>who meet the requirements<\/strong> of the employer&#8217;s request for employment in a specific workplace. On the occasion of the submitted request for the implementation of the labor market test, the National Employment Service <strong>prepares a report<\/strong> on the realization of the need for employment <strong>within 4 days<\/strong>.<\/span><\/p>\n<p class=\"p1\"><span style=\"font-size: 17px; color: #000000;\"><span class=\"s1\">The National Employment Service <strong>evaluates the fulfillment<\/strong> of employment conditions, special cases of employment or self-employment of a foreigner with a rating <strong>of &#8220;fulfills&#8221; or &#8220;does not fulfill&#8221;<\/strong>.<\/span> The grade <strong>&#8220;fulfills&#8221;<\/strong> also includes the <strong>time period<\/strong> for which the assessment is made, which can be up to three years at the longest. On the other hand, the grade <strong>&#8220;does not fulfill&#8221;<\/strong> contains <strong>the reasoning why<\/strong> the conditions for employment, special cases of employment or self-employment of a foreigner <strong>are not met<\/strong>. The assessment is carried out and submitted to the Directorate for Foreigners <strong>within 10 days <\/strong>from the day of receipt of the orderly request for issuing an unique permit.<\/span><\/p>\n<p class=\"p3\"><span style=\"color: #ff0000;\"><strong><span style=\"font-size: 19px;\">ASSESSMENT FOR SPECIAL CASES OF EMPLOYMENT OF FOREIGNERS<\/span><\/strong><\/span><\/p>\n<p class=\"p3\"><span style=\"font-size: 17px; color: #000000;\">The National Employment Service evaluates the fulfillment of requirements in special cases of employment of foreigners: with <strong>referred persons<\/strong>, with <strong>movement within a company<\/strong> and with <strong>independent professionals<\/strong>.<\/span><\/p>\n<p class=\"p1\"><span style=\"font-size: 17px; color: #000000;\">The National Employment Service assesses the employment of <strong>referred persons<\/strong> based on the fulfillment of the following conditions:<\/span><\/p>\n<ul class=\"ul1\">\n<li class=\"li5\"><span class=\"s4\" style=\"font-size: 17px; color: #000000;\">the existence of a <strong>contract on business-technical cooperation<\/strong> between the employer and the foreign employer<\/span><\/li>\n<li class=\"li5\"><span class=\"s4\" style=\"font-size: 17px; color: #000000;\">that the referred person <strong>has been employed and registered for compulsory social insurance<\/strong> with a foreign employer <strong>for at least one year<\/strong><\/span><\/li>\n<li class=\"li5\"><span class=\"s4\" style=\"font-size: 17px; color: #000000;\">the existence of an <strong>act between the employer and the foreign employer<\/strong> on the referral to temporary work in Serbia<\/span><\/li>\n<li class=\"li5\"><span class=\"s4\" style=\"font-size: 17px; color: #000000;\">that the foreigner <strong>will be returned to work for a foreign employer<\/strong> after the temporary assignment expires<\/span><\/li>\n<\/ul>\n<p class=\"p3\"><span style=\"font-size: 17px; color: #000000;\">The <strong>act on assignment<\/strong> <strong>to temporary work<\/strong> in Serbia prescribes rights and obligations based on work, and in particular <strong>must contain<\/strong>: working conditions, <strong>method of providing and amount of salary<\/strong>, salary compensation, working hours, method of exercising the right to annual leave, safety and health conditions at work, period of work, as well as the <strong>way of providing accommodation, food and transportation<\/strong>.<span class=\"s3\"> The referred person <strong>cannot work under less favorable working conditions<\/strong> than those attributed to the Labor Law, e.g. full-time work cannot last longer than 40 hours per week, the duration of annual leave cannot be less than 20 days, etc.<\/span><\/span><\/p>\n<p class=\"p1\"><span style=\"font-size: 17px; color: #000000;\">The assessment for referred persons is carried out for a period of <strong>up to 3 years<\/strong> and can be extended for a maximum of another 3 years.<\/span><\/p>\n<p class=\"p3\"><span style=\"font-size: 17px; color: #000000;\">The Law on the employment of foreigners under the regime of <strong>movement within a company<\/strong> implies the temporary assignment of an employee to a foreign employer for at <strong>least one year as a manager or specialist<\/strong> to work in a branch, representative office or subsidiary registered <strong>in Serbia<\/strong>.<\/span><\/p>\n<p class=\"p1\"><span style=\"font-size: 17px; color: #000000;\"><span class=\"s1\">Under the term <strong>manager<\/strong>, the legislator considers a person:<\/span> (i) <strong>who performs management tasks<\/strong> (who is a director or manager in a foreign company ); (ii) <strong>who is a member of the management<\/strong> of a foreign company;<span class=\"Apple-converted-space\">\u00a0 <\/span>(iii) <strong>who manages the organizational unit<\/strong>; (iv) <strong>who monitors and controls<\/strong> the work of professional or managerial staff. On the other hand, a <strong>specialist<\/strong> is considered a person who possesses <strong>special professional knowledge<\/strong> required for the business of a foreign company, which implies a <strong>high degree of professional competence<\/strong>, or appropriate professional experience and possibly membership in a professional association.<\/span><\/p>\n<p class=\"p1\"><span style=\"font-size: 17px; color: #000000;\">The National Employment Service makes an assessment for moving within a company based on <strong>the fulfillment of the following conditions:<\/strong><\/span><\/p>\n<ul class=\"ul1\">\n<li class=\"li5\"><span class=\"s4\" style=\"font-size: 17px; color: #000000;\">that the referred person <strong>has been employed by a foreign employer for at least 1 year<\/strong><\/span><\/li>\n<li class=\"li5\"><span class=\"s4\" style=\"font-size: 17px; color: #000000;\">the existence of an <strong>act of referral to temporary work in Serbia as a manager or specialist<\/strong><\/span><\/li>\n<li class=\"li5\"><span class=\"s4\" style=\"font-size: 17px; color: #000000;\">that the foreigner <strong>will be returned to the foreign employer<\/strong> after the temporary assignment expires<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/li>\n<\/ul>\n<p class=\"p3\"><span style=\"font-size: 17px; color: #000000;\">For more information on this, as well as other issues in the field of employment of foreigners, you can <a href=\"https:\/\/advokatskakancelarijajecmenica.com\/en\/contact\/\"><em><strong><span style=\"color: #008000;\">contact<\/span><\/strong><\/em><\/a> a lawyer.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The latest changes to the Law on the Employment of Foreigners made it possible to build a new legislative framework that is determined by flexibility, economy and expediency.
